【最新进展】保护凤凰城中国文化中心一周年

去年8月5日开始的请愿是单纯的保护文化艺术的请求。现在已经扩展为争取华人商家享有同等权利的抗争;为了保护亚裔私有财产权益的努力;为了依法保护华人宗教信仰自由的奋斗;为了亚裔以及下一代不被歧视的抗争;为了保护华人文化传统和民族在美国历史的地位之争。

法律一直是我们抗争的最有力的武器。在过去的一年里,维绕着保护文化中心,不同的群体共有10个诉讼案件。特别是老四川起了顶梁柱的作用。在大家共同努力下,琉璃瓦还在阳光下熠熠生辉,江南花园有望早日回到公众怀抱。

到今年5月份为止 侨联共收到捐款$70,119.88。Citizen Voice 共收到捐款$35,945.61。
遵照捐款人的要求,捐款的大部付了律师费用,小部分用于媒体宣传费。

讓歷史告訴现在,讓歷史保存於未來。 也谈 「 實名舉報 」        ( 1 )

鳳凰城中國文化中心的歷史形象

 讀完了壹週報第789期至791期Gary 安專欄中有關「實名舉報」的三篇文章。發現內中有違反私隱權法律之處,有橫行武斷之處,更有妄下結論之處。
違法之處:壹周报于2017年12月8日(第789期)刊登了Gary 安的署名文章“实名举报(一)”。该文章将本地侨社寄给中国中央纪律检举机构的私人信件公诸于众。在未经写信方许可的情况下,将一封私信变成了公开信。更为恶劣的是,信中11位签名人个人隐私信息(姓名,指纹,电话,邮箱)被赫然公布在该期报纸上。此举严重侵犯了当事人隐私。仅指纹泄露一项就会给当事人终身带来不可估量的损失和困扰。亦因此,11位隐私受害人严正要求壹周报/Gary 安停止并纠正侵权行为。受害人保留进一步追究法律责任的权利。

妄作武斷之處:在壹週報第790期的Gary安專欄中,引用了一位所謂了解「中國政策」的專家,對「鳳凰城中國文化中心」的定位之後,有如下的武斷:
「如果我們去查當年中糧在亞省購買中國文化中心這塊產業時的資料,我們會發現當時的所有資料文件中,根本就沒有提到中糧購買的產業是要建設一个鳳凰城中國文化中心的內容。如果是為了建造鳳凰城中國文化中心而購買產業,而美國聯邦政府和當地政府也不會批准這項房地產交易。」
這一點,农民画家在12/19/2017的文章「也談實名舉報」中已經有反駁,而且非常到位。
雖然鳳凰城中國文化中建設於廿年前,雖然那時很多本地華人還未來到鳳凰城,但是歷史終歸是歷史,走過的必定會留下痕跡,況且,這是整個華人華僑華裔走過的歷史道路,當然也是當年政府和各級相關的部門、主流社會的政界、經濟和學術界,以及數以百萬計的亞省和鳳凰城各族裔的民眾所經歷過的歷史進程。
作為一個當年目睹「中糧中國文化中心」誕生的見證人,作為一個「亞利桑那華人歷史協會」的成員,發掘、研究、保存華人歷史文化資料不單是自身的任務,更是一種不能推卸的職責。下面的視頻源自於2007年,是「鳳凰衛視」在鳳凰城所拍攝的資料,保存了10年,一度無法找到,詢問過我曾服務了廿年的鳳凰衛視總部,也回應無法找到。最近,終於再次在塵封已久的舊電腦檔案中尋回。現把這些事實公諸於世,讓歷史告訴现在,讓歷史保存於未來。

        在壹週報/Gray安专栏「實名舉報」(二)中,有這麼一段文字:「中國文化中心的名稱由來是當地華人華僑後來使用這里多了,并經常租用中糧產業和地點辦中國文化周活動,時間久了,一點一點就在亞省華人華僑心目中把那個地方變成懷念大陸親人,按觸中華文化、聯繫亞省華人華僑,建立思想交流和增強中國情懷的文化中心。」
        真是這樣的嗎?這段文字反應了安先生對鳳凰城中糧中國文化中心歷史的無知,而且是本末倒置和憑空想像出來的。
        亞利桑那州立大學任教的司捷教授,在鳳凰衛視訪談節目中,就當年鳳凰城中糧中國文化中心還在規劃建設時就說到,當BNU總經理于寧给大家展现这个项目時,到處坐满了人,大家都非常激动,這是一個非常好的一个项目,大家都特别热情,因為把華人都凝在一起了,這個宏图讓大家非常非常振奮!
         在1998年十二月二十二日,中粮凤凰城中国文化中心举行了剪彩开业典礼。中粮鳳凰城中國文化中心总公司董事长周明臣和中国驻美国大使李肇星,参加并主持了开业庆祝仪式,發表了熱烈詳溢的講話。李肇星大使明確地提到:這是一個「亞利桑那州鳳凰城的中國文化中心」(視頻1)
        鳳凰城中糧中國文化中心建成後,得到了市政府和主流社會的贊譽,政要們對中國文化中心在鳳凰城各方面的貢獻給予積極的評價,認為有著不可取代的地位。
       鳳凰城市經濟發展部部長Paur Katsenes說道:能讓這么多鳳凰人去一個能反映中國文化的聚集點,這是中國文化中心的意義所在。文化中心讓我們了解中國中秋節、春節,以及代表中國文化的事件,我們可以在這里購物、用餐和社區服務,所有這些都能在此實驗。這就是為什麼中糧集團是鳳凰城的一個極其重要的合作伙伴。
        亞省前華裔州眾議員Berry Wong 说道:不像其他美国大城市,以前我们并没有中国城,没有什么能称得上代表中国。这里的华人和华裔也没有一个统一社区,而这里,才是亚利桑那第一个实实在在的中国文化中心。(视频2)
        凤凰城执行长官原市规划局局长Dave Richert更高度概括:中国城为各国进行国际贸易提供了长期或短期的场所,多年来,我对许多社区进行了调查,发现这里有不同的族裔,包括有中国人,日本人,以及其他亚洲国家的人们,这一切都有利於凤凰城的发展,这里有大家共同的梦想,把这里建成商业中心,加强与周边的联系,这也是中国文化中心存在的意义所在。(视频3)
        在实用功能性和便利性上,中国城文化中心整体建筑风格,从各个侧面尽可能多的表现中国文化的元素,加上园林庭阁排楼的渲染,任何人都可以一眼就认定中国城有着不可取代的地位。(视频4)。
        這些當年的視頻,生動形象地反映了鳳凰城中糧中國文化中心從規劃到建成,以及其後十年中所作出的成績和貢獻,也形成了中國文化中心的多層次的歷史形象和內涵。

在保护中国文化中心的问题上,许多朋友之间有不同的见解,这虽然在朋友们的心中产生了一定的隔阂,难能可贵的是很多朋友间多年的友谊并没有因为意见相左而出现大的裂痕。可以预料到的是,文化中心的未来应该在新的一年里确定下来。农民画家想就如下几个大家关心的和比较有争议的问题与朋友们讨 论。期待达成相互理解和共识,求同存异,共同为华人社区和团体在美国的繁荣尽力。

经常听到如下几个说法:

 1, “买家购买了之后是他们的私有财产。就像在你我各自家的后院一样,要做什么是他们受法律保护的权利。我们华人的干涉显示了我们部分华人朋友的无知”

2,”这种贪污是小巫见大巫,又是天高皇帝远的事。我们何必管呢”

3,“不论华人如何努力,都很难挽救文化中心被拆除的结果”

这些说法其实都是非常难以反驳的。相信每个人经过自己的思考后,都会有自己的选择。这里农民画家以自己在保护文化中心的过程中的一些思考和挣扎,提供给朋友们作为参考,也算是给关心文化中心的朋友们的一个新年礼物。

三个基本问题
朋友们的许多问题,仔细想一下,实际上都可以归结为下面这三个基本问题:
要不要保护文化中心?
私有财产神圣不可侵犯?
能不能保住文化中心?
第一个问题是大家有争议的问题,第二个问题是很多人没有参加到保护文化中心活动的主要原因。第三个问题的答案,在很大程度上,取决于大家的努力。现在看来至少有50%的机会可以保住文化中心。

为什么要保护文化中心
很多时候,我们不知道别人心里想什么,所以只能将心比心。记得在去年8月的某一天,农民画家突然听到文化中心的江南花园将被拆除,在摄影群主的感召下,去最后再看一看,拍几张照片。很多东西都是在要失去时才发现珍贵。农民画家的母亲是镇江人,父亲是湖州人,可以想像到当我发现在美国的沙漠里,有这么多家乡的原汁原味的古典园林景观时,我的第一个反应,就是我们应该千方百计的保护这个凤凰城内的中国艺术珍品。带着这个想法,当天就上网查找北美的中国花园,发现凤凰城的江南花园是北美为数不多的几个花园之一。现在在华盛顿DC,正在筹款建造一个中国花园,估计要化费一亿美金。保护住文化中心,就是为画家保护住了一个思念家乡的风水宝地。也是为亚省人民保护住了一个重要的东方艺术珍品。

为了下一代的下一代
农民画家保护文化中心的另外一个私心,是想让画家刚满周岁的外孙女将来可以看到这个东方文化珍宝。这个私心是有两层含义的,一个是希望文化中心能够帮助下一代的下一代不忘中华文化艺术。另外更深一层是担心文化中心被拆除,会以事实又一次证明,华人是好欺负的,他们不会出来保护他们的利益。近几年全美各地专门针对华人的犯罪行为,以及专为华人设计的歧视华人法案,屡屡出现。凤凰城文化中心被拆,会对凤凰城下一代的下一代华人的成长环境,造成不可估量的恶果。

应该保护是很多人的共识
过去几个月来,农民画家非常欣慰的发现,很多朋友由于各种原因,也许也有和画家一样的私心,参加到保护文化中心的活动中来。上个月还有一个朋友自豪地告诉我,她参加了三次保护文化中心的游行活动。

私有财产神圣不可侵犯
很多朋友对保护文化中心的最大疑惑,就是由于这个说法。在去年夏天,农民画家对文化中心的产权结构,是完全无知的。经过近半年的了解,现在知道文化中心是一个商业小区,真北公司买下的,是小区95%的产权。这个商业小区,由于在审批和建造过程中,有凤凰城市政府和华人社区的参与,有小区专门的批文的规划法规。所以文化中心并不是真北公司的后院。另外一个重要的却被大家经常忽视的问题是,小区里的其他业主和小区内的其他租户,也都有神圣不可侵犯的有形和无形私有财产。文化中心过去半年的实际情况是,真北公司和中粮的某些人在文化中心“无法无天”地要拆除中心的中国元素,多次违反小区和大区管理委员会规定,将文化中心公用的江南花园,没有经过批准就围了起来,在网上多次反复关闭文化中心。这种种行为,给小区内的其他业主和租客造成了巨大的财产损失。正因为如此,已经有两个商业诉讼案,老四川餐馆和欣欣超市,分别控诉真北公司。农民画家相信,随着时间推移,会有更多的受害人站出来,控诉损害他们神圣不可侵犯的私有财产的人。

是不是由于嫉妒别人贪污
很多朋友问为什么凤凰城的华人对文化中心转让有这么大的反弹,而中粮BNU同时卖掉的赌城的两个公寓建筑群却没有很大反响。农民画家相信,大家并不是特别关心和嫉妒谁贪了多少中国政府和国企的钱,问题的关键是凤凰城这个一定要拆毁中国城的局,设计得太恶,有关企图获利的人士几乎没有给凤凰城的华人留下其他可行的选择。

能不能保住文化中心
去年八月时如果有人问,能不能保住文化中心?我只能如实回答:机会虽然渺茫,但是如果不努力保,中心一定会被拆毁。现在来看这个问题,其实前景已经大为改善,现在农民画家对这个问题的答案是:有50%的机会能保住文化中心,但是如果不努力保,文化中心还是很有可能被拆除。

愚公移山
凤凰城的华人以及关心文化中心前途的朋友们,如果说去年夏天,你有很多疑惑,要不要出力保护文化中心,请你再仔细想一想,现在实际上是最应该站出来保护文化中心的时候。在新的一年里,让我们大家一起努力,愚公移山,把50%的几率变成文化中心保护下来的实际结果。

文化中心 (十二)围绕产权交易的层层迷雾

凤凰城华人保护文化中心的抗争,已经进入第五个月了。保护文化中心遇到的一个最大的困惑,就是人们所面对的不仅仅是新业主要拆毁文化中心。文化中心的原业主中粮分公司BNU,BNU总经理吴谦,以及同时在BNU和真北公司供职的Robert Reblin,一直在为帮助真北公司拆除文化中心,努力工作,创造各种条件。在这里,农民画家想通过几个月来发现的新老业主关系的蛛丝马迹,以及文化中心买卖交易中的有关文件,与大家共同探讨文化中心交易中的问题。希望这些探讨能够帮助我们找到保护文化中心的关键。

文化中心的两次交易
文化中心是在不到一年的时间里,经历了两次交易之后,才花落现在的第二个买家,真北公司之手的。由于第一个买家没有赚到很多钱,而且是一个信息保密的 Delarware 公司,很多人自然而然地想到这是一个“白手套”皮包公司。几个月来,很多人都在试图寻找有关文件,到目前为止,大家不知道这个公司的股东是何方神圣,只知道这是一家为了买卖文化中心而专门成立的注册公司。

7百万美元的改建贷款
更为奇怪的是,据了解,中粮在第二个买家买到文化中心之后,专门给新业主提供了一笔约为700万美金的改建贷款,用于文化中心的改建工程。这个贷款合同的条款是保密的。在老四川的诉讼案中,新业主宁可放弃保证金,也没有将这份合同上交给法庭。农民画家猜想,这份合同应该对中粮BNU和新业主真北公司的新的“合作伙伴”关系有非常清楚的规定。

BNU补签的多份法律文件
通过老四川的诉讼案,我们了解到,在文化中心转手之后,BNU的文化中心管理公司,不顾小区和大区的管理法规,做了许多违法乱纪,损害其他业主和租户利益的动作。特别令人不能容忍的是,BNU还配合新业主,补签了许多本来没有的法律文件。有些文件甚至连签名日期都是空出来的。

狼狈为奸的中粮BNU和真北
五个月以来,保护文化中心的群众一直都在反对新业主企图拆毁中心的各项措施。大家从这些活动中,越来越清楚的认识到,中粮的BNU,特别是总经理吴谦,其实一直都在第一线,为拆毁文化中心努力。文化中心事件中举足轻重的前台人物 Reblin 先生,在法庭上亲口承认他同时受雇于中粮BNU和新业主真北公司。就是这个Reblin 先生,亲口告诉被他驱赶的欣欣超市的赖老板,说自己是新业主的合作伙伴。还是这个Reblin 补签了许多个小区和大区的法律文件,为将新业主的拆毁活动合法化,提供了全方位的帮助。

神秘的Joint Venture
也许造成现在这一切的关键一环,“白手套” Delarware公司的股东公司的名字,可以给我们一个重要提示。这个全名叫 “44 Airport AG JV LLC” 的公司,是第一个买家的实际控制公司。据了解很多内部情况的朋友解释,上面名字中的 JV缩写原于英文的 Joint Venture 两个单词。中文的翻译应该是“联合风投”,意思是双方联合投文化中心的险。如果这个解读正确,那么这双方的一方应该是中粮和BNU有关的某些人,而另一方则是新业主真北公司。

不论如何,保护凤凰城文化中心的群众必须面对的是:中粮(狼)和 真北(狈)的联合体。

也谈实名举报(二) 农民画家

上周的壹周报,在Gary安专栏,刊登了实名举报(三)。
这篇文章,和Gary安的前两篇一样,让我们这些普通人读起来,感觉好像是读天外飞来的文章。好在我们已经对Gary安的前两篇文章有了一些理解,农民画家将自己对第三篇文章的理解,写出来和关心文化中心的朋友们分享。

安师傅文章的主要内容
修车师傅Gary安是凤凰城很多人都认识的人,农民画家的好几个朋友都在Gary安那儿修过车。他的这篇文章的内容丰富,主要是围绕着以下几个有关吴谦和文化中心的问题来论述的:

吴谦的多栋豪宅都是谁的?
对吴谦的前途的预期,中粮和新业主的关系,举报吴谦就是举报中粮,就是与中国政府过不去。

让我们来仔细读一读,想一想安师傅的关于吴谦和文化中心的这些有关论述。

吴谦的多栋豪宅
根据壹周报的第三篇实名举报文章,实名举报中的一个重要内容是,吴谦和太太以及女儿在美国各地有拥有多处豪宅。举报者指出这些财产与吴谦靠给中粮打工的收入是不相符合的。安师傅在文章中并没有直接说这些财产没有问题,而是用讲故事和类比的手法,让读者了解,还有另外一个可能性,就是这些在吴谦和家人名下的房产很可能是吴谦替中国国内“别人”利用他和他家人的名字在美国购买的,将来还要把产权转给“别人”。这个说法有可能开脱了吴谦的“监守自盗”国有资产的问题,但是在同时,安师傅的文章似乎又将吴谦陷入了越境洗钱的境地。越境洗钱和用某人的名字给“别人”买房在美国应该都会有很多法律问题的。

对吴谦前途的预期
安师傅用了一些笔墨,让读者了解到,所谓吴谦贪腐的问题很可能是吴为国内上级领导背的黑锅,由此非常有可能在不久的将来,吴会在大的国有企业担任重要职务。文中还说 “回过头来再看实名举报中粮集团总经理吴谦一案,...”,更让读者摸不着头脑,吴谦是BNU的总经理不假,可是从什么时候开始,吴谦成了中粮集团总经理?

中粮和新业主的关系
安师傅在文章中指出,由于新业主在老四川的诉讼案中,没有因为遇到产业纠纷而状告中粮集团。因此得出新业主代表的是中粮集团的利益的结论。这实际上是在说企图拆毁凤凰城文化中心是中粮集团领导们的主意,吴谦只是奉命行事。只是我们不知道中粮集团到底有没有给吴谦这样一把上方宝剑。

“举报吴谦=与中国政府过不去”?
最为令人匪夷所思的是,安师傅通过一系列类似于“白马非马”的推论得出了如下的结论:“换言之,举报吴谦,就是举报中粮,举报中粮,等同与中国政府过不去。”。读者感到非常困惑的是,吴谦在凤凰城的所做所为,能够代表中粮集团领导吗?能够代表中国政府吗?

180度的大转弯
安师傅的文章结尾来了一个180度的大转弯: “通过实名举报事件,我们看到了亚省华侨一片热爱中华的赤子之心, ......” 。这种跳跃式的行文风格可能有两种解释:一种是安师傅写文章时就是同时有两个不同的声音在大脑中打架,这一段代表一个声音,下一段代表另一个声音;另外一种更富有想像力的解释是,安师傅和吴谦的朋友一起写了这样几篇重要文章,目的主要是为吴谦开脱责任。最后,良心发现,安师傅又加了一段维护举报人的话。

似乎中国领导人已经读过了凤凰城华人报纸上用安师傅名义发表的这三篇文章,作为回应,圣诞节当天,国内传来了关于 “严防国企海外腐败风险问题” 的一系列消息。时间会慢慢展现吴谦,安师傅以及国内“别人”们未来的前景。

Chinese Community asked two questions to the Phoenix city Mayor and councilmembers

Today I don't need to talk about how precious and how special the Chinese Culture Center is. For this issue, we have already talked so much that you probably have heard far more enough!  At this moment, I just want to tell you that I couldn't understand why the City Planning and Development Department still issued the TN Company the permit to let them removing the tile roof of the Chinese Culture Center.

First of all, I would like to talk about the 1996 enacted zoning Stipulations. Its #13 is to protect the right of the property owners' association, which was formed for the purpose of defining and implementing responsibilities for the maintenance of the  infrastructure, open space, and public amenities, and the property owners' association shall be maintained in perpetuity.

Within the same Chinese Culture Center, not only is TN company a property owner, but also is the Sichuan Palace Restaurant. As a property owner, the Sichuan Palace Restaurant should be the member of the property owners' association with no doubt. I wonder if the City Planning and Development Department ever got the agreement from the Sichuan Palace Restaurant before they issued a permit to TN company and allowed them to reconstruct the roof of the CCC? Now, my question is: why the city government only takes the TN's right into their consideration but totally ignores the right of Sichuan Palace Restaurant? Just because they are minority Chinese business? What a double standard you have?!

The stipulation #15 states that any request to amend these stipulations (including stipulation #14 requiring commencement of construction within 18 months) must be brought back to the planning commission for public hearing.

On October 31, 2017, the City Planning & Development Department issued the permit to the TN company for the replacement of the current tile roof of CCC without any public hearing. Here, my question is: does this violate the ordinances of the zoning stipulations?

The stipulations #11: “The property owner shall participate in the public art program for the project in coordination with the commission on the Arts for the City of Phoenix and Consistent with the guidelines adopted by the City Council on March 16, 1988”.

Over the past 20 years, the Chinese Cultural Center has indeed to make these significant art pieces, gardens and community square open to the public.  These art features of the Chinese Cultural Center constitute the “public art program for the project.”  They cannot now be removed and sent to a landfill (as the owner has threatened to do). Any request on the new owner’s part to unilaterally modify this public art program, will violate Stipulation #11 and will require a public hearing to seek a modification. Now, my question is: did the City Planning & Development Department request the TN company to follow the requirement of this particular stipulation?

Secondary, I would like to talk about the Arizona Proposition 207. A 2006 ballot initiative officially titled the "Private Property Right Proposition Act". "207" requires the government to reimburse land owners when regulations result in a decrease in the property's value, and also prevents government from exercising eminent domain on behalf of a private party.

The TN company is using the Proposition 207 to threatened the city government as they attempt to bypass a public hearing. Now, I have the following two questions:

(1) Have the Phoenix city government ever even tried to preserve the CCC, which cause the TN property's value decrease?

(2) Does the value of TN's property really decrease? They bought the CCC in June of 2017 for 10.5 million dollars and only four months later, the Chinese Community would offer much higher price to purchase back the CCC. Therefore, how can they claim their property is devalued? What compensation should they require from the city government?

The third, our Chinese American Community are serious to purchase back our treasure-the Chinese Culture Center. We therefore urge the TN company to contact the Chinese United Association of Great Phoenix directly, not through the media, not lie to the public, please sit down at the negotiation table, face to face and sell the property!

President Trump is currently visiting China, and  the following photo is taken today.  It is in front of the Hall of Supreme Harmony,  one of the biggest and most important piece of architecture in the Forbidden city. Forbidden City was built by the ancestors  of the same crafts master (XiangShanBang) who built the Phoenix Chinese Cultural Center.  It is also built with the materials made by the same Royal Kiln.   

 

These Photos can help Phoenix people and the city government to understand the value of the Chinese Cultural Center, especially its royal roof tiles. Therefore, all effort to protect them will be for the benefit of the history, as well as for the benefit for the city of Phoenix.

 

This is confirmed by the center's chief Chinese architect Madame Ye Juhua: "The XiangShan ( Fragrant Hill ) of Suzhou is located by the side of  Lake Taihu and is well known for producing China’s highest quality building artisans, who are steep in intricate traditional Chinese building techniques for centuries.  Those Crafts masters therefore are called XiangShan Bang because of where they are located. When the third emperor of Ming Dynasty decided to move the Capital from Nanjing to Beijing in the early 15th Century, He collected these master craftsmen from XiangshanBang to Beijing to help to build his palace. One of the most brilliant representative of XiangShanBang craftsmen is called Kuai Xiang, and he later became the chief architect, designed and built TianAnMen (Gate of Heavenly Peace) and the three main Halls and many other buildings in the Ming Dynasty’s Imperial Palace in Beijing (also commonly known as the “Forbidden City”).  After that ShangShan Bang became known all over China for its finest craftsmanship, and because of Kuai Xiang’s  outstanding achievements, KuaiXiang  is considered to have represented the best skills of Xianshan Bang’s ancestors.  "  

 

The roof of the Forbidden City has already last over 600 years, while the roof of the Phoenix Chinese Culture Center is only 20 years, and can last a long time ahead of them. So the statement on the roof replacement permit as  " replacing anaging 20 year roof " is completely wrong and will be an laughing stock misstatement.

 

We are also of the opinion that when the President Trump returns from his trip to China, he and his reporters will help the United States understand more about the value of these classical Chinese architectural buildings, and durability of those roof tiles.  Therefore, the preservation of the Chinese Cultural Center will be better understood by more citizens in U.S. and in the world. 

Why is the Garden at the Phoenix Chinese Cultural Center so precious?

First: The pavilion at the Chinese Culture Center is mostly possible the only overseas replica (now and in the future) of the Pavilion of Surging Waves located in Suzhou, which was included in the World Heritage List in 2000. Chinese government has not allowed the Pavilion of Surging Wavers to be replicated overseas from then on. The technique used for the pavilion at the Chinese Culture Center in Phoenix is a very ancient Chinese technique, building without nails or screws. All connections of the pavilion happened by complex joinery techniques. The longer the pavilion stands, all wooden parts become more solid as a whole.

Second: Besides the materials for the pavilion, most of other materials for this center were imported from China as well 20 years ago. The materials are made by Chinese ancient/traditional techniques. For example, the tiles for the roof were made of clay which need to be soaked (on purpose) in ponds for tens of years; and then is sintered in traditional Chinese sintering ovens. Now, this kind of traditional Chinese sintering ovens are replaced by western modern sintering ovens. There are few manufacturers making this kind of roof tiles in China now.

Third: The carpentry used to build the center is from an ancient Chinese school, which has been lasted for hundreds of years and was used to build some imperial palaces in China hundreds of years ago. The carpenters who built the center were sent by Chinese government and their visas were granted by American embassy as a special case then for building the Chinese Culture Center in Phoenix. These carpenters were best carpenters in China then, and they become old or passed away now. The carpentry is also vanishing in China since the modern technologies enter China.

She/He was so impressed by the beauty of the center, and said the center has small but excellent replicates of the attractions in China, which makes her/him feel still staying in China and let her/him remember the stories and histories behind the (original) attractions. As a summary, I would like to emphasize that the Chinese Culture Center is a precious treasure to Phoenix city and to USA. Through the Chinese Culture Center, China sent its ancient architectures and histories to USA (and Phoenix). I really think that the Chinese Culture Center in Phoenix is such a beauty which we should keep well and pass down from generation to generation.

美国凤凰城中秋大游行能保住华人文化圣土吗?

2017年中秋节当天,美国亚利桑那州凤凰城的华人做了一件美国华人历史上值得一书的壮举。许多人专程请假参与2017年10月4日凤凰城市议会和集会,共有五百人左右的华人和其它族裔的友人顶着烈日,忍受36℃的高温,再次就当地华人社区保留“中国文化中心”在市议会门前的集会游行,请求市政府和市议会帮助保住华人心中的文化圣地——凤凰城中国文化中心。

Good afternoon council members,

I’m Yuxuan Deng and I’m 11 I go to Bahsa’s Accelerated Middle School.

The first time I heard about this crisis is at the beginning of August my mom told me and my brother that if we wanted to save this Chinese garden then we will need to hire a lawyer, so me and my little brother donated $200 from our salaries. I also wrote a letter to the mayor on August 13th about supporting us on preserving the center and how valuable and special the center is. I’ve been to 3 of the protests which was on August 13th the first protest, August 20th the second protest, and August 26th the Candlelight blessing of L ranch supermarket, it is a shame that on September 12th that I couldn’t go to the Hearing but I did manage to get all the speeches on YouTube, my favorite speech was Elizabeth Mann’s presentation. After listening to her speech, I learned that the Chinatown used so much of these highest qualitied construction materials, which is extremely surprising.

My mom went to all of the protests except one, but the most recent and frustrating protest on September 21st is when my mom and several other people went to pray to Guanyin , and when she and her friends were about to enter a Chinese restaurant at the center for lunch , a female patrol guard told my mom that she couldn’t stand there because it was private property, and she groundlessly accused that my mother will cause damage to the property; eventually my mom and her friends left without lunch due to her harassment, and that is how unreasonable True North has been. I wish I was there to protect my mom and reason with her, how can you interfere with the restaurant owner and customer’s rights to conduct normal business?

Here’s a question, would you prefer a mediocre headquarters for a casual company or would you want an antique Chinese garden that only exists in Arizona? The garden is very precious and unique as described Elizabeth Mann, because the specialized builders are already retired and unable to build these kinds of centers anymore. And its unique materials are no longer available. It’s also a historical site with a variety of agricultural styles from china and it will be the one and only Chinese garden that is this glorious and beautiful True North companies is trying to take away this historical beauty and replace it with an ordinary company HQ.

So, Which side do you choose? The cultural center of True North?

A while ago, I went to a shopping center at night to pass out flyers about our effort to save the garden. To my surprise, more people than not had already heard about it and they all expressed their support and they cannot understand why would someone destroy such a heritage and gift to humankind. They felt that this cultural center does not only belong to the Asians community, but to all Arizona residents and even the visitors from other countries and states, because it’s so rare and unique. History will record the infamy of those who destroy it for sure.

STOP!!! New owner! Don’t destroy this HeYuan full of Chinese Element!!!
STOP!!! Phoenix city Council, don’t give the license YGH or the Chinese Culture center will be ruined!!! STOP! STOP!! STOP!!!

Dear Mayor and The Phoenix City Council,

I’m Ryan Deng. I’m eight and a 3rd grader at Khalsa Montessori School in Phoenix.

Do you like vacation? Of course you do. You’ve probably been to Europe and others, but have you ever been to China or Asia? Do you know how much it costs to take a plane to Asia? Over one thousand dollars at least. Now that’s a ton. But have you realized how much you would spend for staying at a hotel, dining and so on? It might already eat up thousands of’ bucks (not yuans). Have you ever heard about the COFCO center at 668 N 44th Street, Phoenix, AZ? If you go there it is way cheaper because all you have to do is just use some gas, but it does break a bit of the ozone layer; still it’s better than having to ride a plane for a day or two.

The center was built by Chinese professional architects twenty years ago, and it took them months and years. And now the new owner plans on crushing it with bulldozers (maybe). It was really hard for the artisans and now there aren’t many good architects any more to build it so if it’s destroyed the percentage of a new one appearing somewhere else is somewhere around 10 percent. That’s not much! The beauty and culture of the center is really similar to the ones in China. In fact, the McDonald, Burger King, Starbucks, KFC and Pizza Hut restaurants in China are all decorated in a fancy Chinese way and the buildings are alike the COFCO center. But the center is also a bit more special than the real China. You know why? Because the center shows so many cool features like the Monkey King, Confucius, and the Pigsy statues.

I haven’t been there yet but I’ve heard about how beautiful a place it has grown in to. My mom has told me about it too! And I really wish I could go there after it reopens. But if it dies at the owner’s hands that would make me very disappointed and furious. Plus, if it gets saved we will make it an even better tourist attraction. So please help protect it.
